Last updated: January 25, 2026

ClaimAI ("Claim," "we," or "us") provides software that helps merchants understand how AI systems and agents interact with their products and content. We respect merchant privacy and are committed to protecting all data accessed through the Claim app.

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, this policy also serves as our GDPR-compliant privacy notice. Please read it carefully. This Privacy Policy is part of and subject to our Terms of Service.

1. Data Controller

Claim acts as the data controller for personal data processed through our platform. Our services are operated from the United States. If you have questions about how we handle your data, contact us at:

2. Information We Access

When you install Claim, we may access the following information, only as needed to provide the service:

  • Store and account information
  • Product data (titles, SKUs, pricing, availability, descriptions)
  • Usage data related to app features and performance
  • Technical data such as IP address and timestamps

We only access data explicitly authorized by the merchant.

3. Lawful Basis for Processing (GDPR)

If you are in the EEA, UK, or Switzerland, we rely on the following legal bases to process your data:

  • Contract performance: Processing is necessary to deliver the Claim app and services you have subscribed to.
  • Legitimate interests: We process certain technical and usage data to maintain security, improve our platform, and prevent fraud, where these interests are not overridden by your rights.
  • Legal obligation: We may process data where required to comply with applicable law.
  • Consent: Where we rely on consent as a legal basis, you may withdraw it at any time without affecting the lawfulness of prior processing.
4. How We Use Data

We use merchant data to:

  • Operate and improve the Claim app
  • Generate AI visibility, attribution, and diagnostic insights
  • Provide dashboards, alerts, and reports to the merchant
  • Maintain security and reliability of the platform

We do not use merchant data for unrelated purposes.

5. International Data Transfers and Data Storage

Your data is stored and processed in the United States.

If you are located in the EEA, UK, or Switzerland, this means your personal data is transferred to a country outside your jurisdiction. We implement appropriate safeguards to ensure this transfer complies with GDPR requirements:

  • Standard Contractual Clauses (SCCs): Where required, we enter into the European Commission-approved Standard Contractual Clauses with our service providers and sub-processors to provide a legal mechanism for international data transfers.
  • EU-U.S. Data Privacy Framework (DPF): Where applicable, we work with U.S. vendors certified under the EU-U.S. Data Privacy Framework, which provides a valid legal basis for cross-border transfers under GDPR.
  • Supplementary Measures: We apply additional technical safeguards such as encryption in transit (HTTPS) and encryption at rest where required to maintain an adequate level of protection for transferred data.

You may request a copy of the applicable transfer mechanism we use by contacting us at privacy@claimainow.com.

6. Data Protection Agreements (DPAs)

We enter into written Data Protection Agreements with all third-party vendors and sub-processors that process personal data on our behalf. These agreements require our sub-processors to:

  • Process data only on our documented instructions
  • Implement appropriate technical and organizational security measures
  • Assist us in fulfilling data subject rights requests
  • Delete or return data upon termination of services

A list of our key sub-processors is available upon request at privacy@claimainow.com.

7. Data Security

We follow industry-standard security practices, including:

  • HTTPS encryption for all data transmission
  • Encryption of data at rest
  • Role-based access controls limiting who can access data
  • Monitoring and logging of system access
8. Data Sharing
  • Claim does not sell or rent merchant data.
  • Merchant data is not shared with third parties except as required to operate the app (e.g., cloud infrastructure providers and analytics tools bound by DPAs).
  • Any shared analytics are aggregated and anonymized.
  • We may disclose data if required by law or court order, in which case we will notify you to the extent legally permissible.
9. Data Retention and Deletion
  • Data is retained only while the merchant account is active.
  • Upon app uninstallation or request, merchant data is deleted or anonymized within 30 days.
  • Merchants may request deletion of their data at any time by contacting privacy@claimainow.com.
  • Certain data may be retained longer where required by legal obligation (e.g., financial records).
10. Your Rights Under GDPR

If you are located in the EEA, UK, or Switzerland, you have the following rights regarding your personal data:

  • Right of access: Request a copy of the personal data we hold about you.
  • Right to rectification: Request correction of inaccurate or incomplete data.
  • Right to erasure: Request deletion of your data ("right to be forgotten") where no overriding legal basis applies.
  • Right to restriction: Request that we limit how we process your data in certain circumstances.
  • Right to data portability: Request your data in a structured, machine-readable format.
  • Right to object: Object to processing based on legitimate interests.
  • Right to withdraw consent: Where processing is based on consent, you may withdraw it at any time.
  • Right to lodge a complaint: You have the right to lodge a complaint with your local data protection authority (e.g., your national EU supervisory authority, the ICO in the UK, or the relevant authority in your country of residence).

To exercise any of these rights, contact us at privacy@claimainow.com. We will respond within 30 days. We may need to verify your identity before processing the request.

11. Cookies and Tracking

Our app may use cookies and similar technologies for session management and analytics. Where required by law, we will obtain consent before placing non-essential cookies.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify merchants of material changes via email or in-app notification prior to the change taking effect. Continued use of Claim after notice constitutes acceptance of the updated policy.
